Safety & Compliance Management, Inc. (“S & C”) commenced this action against Angela Burgess for her alleged breach of a noncompetition agreement. The trial court subsequently denied partial summary judgment to Burgess and granted partial summary judgment to S & C on the issue of whether the agreement was legally enforceable. For the reasons discussed below, we conclude that the noncompetition agreement is unreasonable in terms of the scope of the prohibited activity and therefore reverse.
