In an action inter alia to recover damages for breach of a contract for the sale of real property, in which defendant counterclaimed for specific performance of the contract, the appeal is from a judgment of the Supreme Court, Suffolk County, entered November 26, 1975, which is in favor of plaintiff, after a nonjury trial on stipulated facts. Judgment affirmed, with costs. The parties entered into a contract for the sale of a parcel of real property on May 13, 1974 wherein the plaintiff agreed to purchase the property for the sum of $140,000.
