PARKER and MAIN, JJ., dissent. The superior court for Snohomish county having admitted to probate as the last will and testament of Louise Hanson (who died October 22, 1930, aged seventy-five years) a document of a testamentary nature, bearing date July 21, 1930, Peter Nerheim, a nephew of Mrs. Hanson, and the Norwegian Synod of the American Evangelical Lutheran Church (which will hereinafter be referred to as the Synod) instituted a contest, attacking the will on the grounds of mental incapacity of the testatrix and undue influence.
