This is an appeal from a judgment of dismissal for lack of diligent prosecution of an action for damages for personal injuries alleged to have been sustained in a motor vehicle accident. The basic facts are as follows:

August 23, 1954, plaintiffs’ automobile was involved in a collision with a vehicle owned by defendant. Plaintiffs’ son, Winfred Gerold Holt, was the driver of plaintiffs’ ear and plaintiffs’ son, Keith L. Holt, and these plaintiffs were riding therein.
