The plaintiff, Patrick Link, brought this action in two counts against the defendant city of Shelton for indemnification under § 53-39U 1 of the General Statutes. The defendant has appealed from a summary judgment rendered on the first count in favor of the plaintiff, formerly a patrolman with the defendant’s police department, holding that pursuant to § 53-39a the plaintiff is entitled to indemnification for “legal fees necessarily incurred” in defending against a prosecution for the crime of breach of the peace.
