■The action is for damages resulting from alleged negligence. The defendant was engaged at the time of the accident in constructing an underground trolley road through Sixth avenue, in the borough of Manhattan, New York city, having a contract for that purpose with the Metropolitan Street Railway Company. It was. also in possession of a permit from the municipal authorities conferring the privilege of placing materials upon the avenue and intersecting streets, subject, among other provisions, to the conditions-that the street should be covered with planking before such material…
