Green, J.:

This action was brought to recover damages for injuries alleged to have been sustained by the plaintiff on the 12th day of October, 1891, by reason of the defendant’s negligence. The negligence imputed to the defendant is,, that a pile of planking and other materials were left unlighted and unguarded in the approach to a public bridge over the Erie canal in Main street, in the- city-of Buffalo, against which the plaintiffwhile going to a fire as a member of the fire department of the city, was driven. This unguarded pile was left in the condition it was on the night of the accident…
