NIX, Judge.

Plaintiff in error, hereinafter referred to as the defendant, was charged by information in the District Court of Oklahoma County with the crime of Grand Larceny, After Former Conviction of a Felony. He was tried by a jury, found guilty and his punishment assessed at ten years in the penitentiary. From that judgment and sentence he has appealed to this Court.

It appears, from the record, that the defendant was observed stuffing money in his pocket and leaving the site of a cash register in a grocery store located in Oklahoma City on March 29, 1966. Defendant was detained while…
