OPINION

The issue presented in this case is whether an erroneous jury instruction about eyewitness identification testimony rose to the level of plain error so as to require a new trial. In 1996, defendant was convicted of first degree murder for the shooting death of Pedro Melquiadez and attempted first degree murder and aggravated battery for shooting Jamie Fragoso.
