This case comes iuto this court on error from the court of common picas of Hamilton county, Ohio, wherein judgment way rendered for the plaintiff below, defendant in err-»r in this court.

The trial was had without the intervention of a jury. No evidence was introduced on the part of the defendant.

The action was bas'd upon a policy of insurance covering accidental breaking of a steam engine in the plant of the defendant in error.
