Plaintiff in error, who was plaintiff below, brought an action against the defendant in error, an interurban electric railroad company.
On the evening of January 1, 1917, he went to the stop of the defendant line of railroad at a point about two and one-half miles from Alliance. He was accompanied by his wife and daughter, and intended to board a car to take his daughter to a doctor.
