Appeal by the defendant, New York Central and Hudson Elver Eailroad Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 12th day of March, 1914, upon the verdict of a jury for $6,000, and also from an order entered in said clerk’s office on the 9th day of March, 1914, denying the defendant’s motion for a new trial made upon the minutes.

Laughlin, J.:

This is a statutory action to recover for the death of Antonio Ricciardelli, alleged to have been caused by the negligence of the defendant.

At six thirty-two A. 11. on the 10th of January, 1913, the decedent was struck by the engine of a north-bound passenger train at the Van Cortlandt Park station of the Putnam division of the defendant’s railroad and was instantly killed. The decedent and eight or ten other laborers were accustomed to take that train daily to go to Pocantico Hills where they were employed.
