delivered the opinion of the Court.
Gill T. Buford commenced this action before a justice of the peace, and therein sought to recover from the Louisville & Nashville Railroad Company damages for the unlawful killing of a mule. He recovered before the justice of the peace, and the railroad company appealed to the circuit court.' In that court the case was tried before the judge without the intervention of a jury, and judgment was rendered in favor of the plaintiff.
