MEMORANDUM OPINION

SCHATZ, District Judge.

INTRODUCTION

This civil rights action arose out of the termination of the plaintiff, Norbert Serafín (hereafter Serafín), from his employment as Superintendent of the Water and Sewer Department for the City of Lexington, Nebraska. Serafín alleges that he was deprived without due process of interests encompassed by the Fourteenth Amendment’s protection of liberty and property, in violation of 42 U.S.C.A. §§ 1982, 1983, 1985 and 1988. The Court has jurisdiction of the parties and subject matter of this suit pursuant to 28 U.S.C.A. §§ 1331 and 1343. Trial…
