Plaintiff-Appellant Jerry Bodie (“Bodie”) brought this action against the defendants-appellees, The Purdue Pharma Company, Purdue Pharma, L.P., Purdue Pharma, Inc., Purdue Frederick Co., and The P.F. Laboratories, Inc. (hereinafter, collectively, “Purdue”), who manufacture and market the prescription drug OxyContin. Bodie argued that Purdue distributed OxyContin without providing sufficient warnings about the dangers of the drug, and that it made affirmative misrepresentations about the drug’s characteristics.
