This is an action in assumpsit to recover the difference between the amount of plaintiff’s indebtedness to defendant on two collateral promissory notes and the amount realized by defendant on its resale of the collateral at a price in excess of plaintiff’s indebtedness to it on the notes. The trial judge directed a verdict for plaintiff and, from the judgment thereon, comes this appeal.
