BULLOCK, District Judge.

This action began on February 18, 1999, when Plaintiffs, North Carolina Alliance for Transportation Reform, Inc. and Friends of Forsyth County, filed a complaint against the United States Department of Transportation (“USDOT”); Rodney E. Slater, the Secretary of USDOT; the Federal Highway Administration (“FHWA”); Kenneth R. Wykle, the Administrator of FHWA; and Nicholas L.
