THIS CAUSE comes before the Court upon the Report and Recommendation [DE 69] of United States Magistrate Judge Ann E. Vitunac. Pending before Judge Vitunac was defendant’s Verified Motion for Attorney’s Fees [DE 47]. Plaintiff filed a response [DE 53], defendant filed a reply [DE 60], and Judge Vitunac held a hearing on the motion on July 23, 2009.
