MEMORANDUM OF DECISION
McGLYNN, District Judge.
In this bankruptcy action, plaintiff, Envi-ro-Scope Corporation (“Enviro-Scope”), seeks the return of commissions withheld by defendant, Westinghouse Electric Corporation (“Westinghouse”), both prior and subsequent to plaintiff’s initiation of Chapter 11 proceedings. Presently before the court is plaintiff’s motion for partial summary judgment and defendant’s cross motion for summary judgment with respect to Count III of the complaint which seeks to recover commissions withheld by Westinghouse subsequent to the bankruptcy filing.
