Plaintiff’s suit was brought to recover from defendant association on a policy of life insurance issued by it to plaintiff’s wife, wherein plaintiff was named as beneficiary. The insured died on Sept. 4, 1922, at which time this policy was in full force and effect. Upon this showing alone plaintiff was entitled to recover the face of the policy. In its affidavit of defence, however, defendant alleged that deceased had died by her own hand, or was a suicide, and if this were true, under the terms of the insurance contract, the beneficiary would be entitled to receive only $438,…
