Defendant appeals from a judgment against it for $12,500 entered upon the verdict of a jury in an action for personal injuries.

There are four counts in the declaration, three of which aver negligence in varying forms against defendant as the proximate cause of the injuries to plaintiff, and the fourth count avers that defendant’s servant, in the operation of its truck upon the occasion in question, when danger was imminent, carelessly, recklessly and wantonly ran the same upon and against plaintiff, thereby seriously injuring him.
