JACKSON, Justice.

This action is for recovery on an open account allegedly due under an oral contract between Lester Vahldick, as plaintiff, and W. H. Strieker, as defendant. The parties will be given their trial court designations.

The defendant, as plaintiff in error here, presents this appeal on several assignments *368of error but we have carefully examined the record and the briefs and have concluded that only one of his assignments has merit.
