Appellant, Wm. Cameron & Co., Inc., sued appellees, Guy M. Gibson and'L. D. Cobb, for the sum of $2,798.80, the value of materials furnished and funds advanced for labor to erect a dwelling house upon a farm owned by appellees, and to foreclose a mechanic’s and materialman’s lien up on 50 acres of land upon which the house was situated. The case was tried before a jury, but, upon conclusion of the evidence, each side requested a peremptory instruction.
