Movant, Ricky Smith, was charged by information with one count of class D felony for violating a full order of protection in violation of section 445.085. 1 On June 17, 2002, Movant pled guilty to the charged offense. On that date, the court accepted Movant’s guilty plea, which called for a suspended imposition of sentencing with the understanding that Movant would reside in the State of Ohio with his mother.
