INTRODUCTION

¶ 1 The State challenges the Utah Court of Appeals’ revei’sal of defendant Dr. Raymond Bedell’s conviction of misdemeanor sexual battery. The State asserts that a panel majority of the court of appeals erred when it reversed Dr. Bedell’s conviction on the basis of ineffective assistance of counsel and plain error on the part of the district court.
