I. INTRODUCTION
James Nelson was seriously injured in a bicycle accident on September 3, 2008, *1140when he encountered a sinkhole/washout on a bike path on United States Air Force Academy [“Academy”] land. He sued under the Federal Tort Claims Act [“FTCA”] for damages.
