SANBORN, Circuit Judge.
This writ challenges the rulings of the court at the trial of an action for damages for negligence which resulted in a judgment for $27,500 in favor of Mr. Runge, the plaintiff below, and against his employer, the May Department Stores Company, a corporation. The plaintiff alleged that he was injured while using an . elevator in the company’s building by its negligence, in that it failed to exercise ordinary care to prevent a heavy truck from running into the elevator shaft and falling upon him.
