Plaintiffs, as first mortgagees, caused certain property, belonging to defendants, to be sold under executory process, on 31st January, 1862, for the sum of $7,900, which was paid in full by the purchaser, Louis Gertris. After paying the claim of plaintiffs, with interest, costs and charges, there remained a surplus of the proceeds of $1,852 88, which the Sheriff reports as in his hands, subject to the further order of the Court.
