CLAYTON, District Judge.

The defendant makes motion to set aside the verdict and judgment heretofore rendered in this case. It *403is unnecessary to-be more particular as to the ground of the motion than as it may appear from my discussion hereinafter. It is sufficient to say the defendant contends that the ruling of the court on the law question involved was incorrect, and that the damages awarded by the jury are unjust and excessive.
