COFFEY, Circuit Judge.

Michael Bischel was charged with conspiracy to distribute marijuana and possession with intent to distribute marijuana in violation of 21 U.S.C. §§ 841(a)(1) and 846. Bis-chel pled guilty to the conspiracy charge and was sentenced on December 12, 1991, to fifty-eight months of imprisonment to be followed by five years of supervised release and required to pay a $50.00 special assessment fee. Bischel did not file a direct appeal of his sentence because he alleges he was under the impression that the government would move, under Fed.R.Crim.P. 35(b) for a further reduction…
