1. Background

National Loan Acquisitions Company (National) filed a motion for summary judgment in a suit on a promissory note against APM Enterprises, LLC, as maker of the note, and Avtar Grewal and Grewal Hotels, Inc., as guarantors of the note (collectively referred to as Grewal). 1 National attached the affidavit of Peter Peer-boom to its motion, stating the note was in default in that it was matured by acceleration.
