KNAPP, Circuit Judge.

The' defendant in error, hereinafter called the "plaintiff,” is a banking corporation located at Mangum, Okl. The plaintiff in error, hereinafter called the “defendant,” is the sheriff of Gaston county, N. C.

On or about May 13, 1911, one O. E. Gibbon, a cotton broker of Marigúm’and customer of the plaintiff bank, bought at Lone Wolf, Okl., 250 bales of cotton which were delivered on that day to the Wichita Falls & Northwestern'Railway Company, at Wichita Falls, Tex., for transportation.
