This writ of error is sued out to review a judgment of the Denver district court rendered in 1927, which set aside and vacated a former judgment of the same court in the same . action rendered in 1922. The action, in which 'the original and vacated judgments were rendered, was .brought by the plaintiff Peterson to recover of the defendant Vanderlip on the latter’s promissory cognovit note of $500 and interest which was made payable to .the plaintiff.
