This hearing is upon a demurrer to a plea in abatement in this court. The action was instituted in the District Court by the defendant in error against the plaintiff in error wherein judgment was entered decreeing, that the defendant in error was the owner of a certain hundred and *223sixty acres of land in Yuma county; that the plaintiff in error had no right, title or interest therein. The decree also cancels a tax deed, as well as certain judgments and decrees and quiets the title to said land in the defendant in error.
