William Loosing was born in Germany, but had resided in Washington county, Nebraska, 45 years next preceding his deatli, which occurred in November, 1905, and will be *68referred to hereafter as the testator. Hannah Loosing, defendant herein, is the testator’s widow. At the time of her marriage she was the mother of an illegitimate infant son, who thereafter resided with his mother and her husband until 29 years of age, in 1890.
