Plaintiff Andrew J. Roberts brought suit against his employer, Norfolk and Western Railway Company (N&W), pursuant to the Federal Employers’ Liability Act (45 U.S.C. §§51 through 60 (1988)) (FELA) for personal injuries sustained during the course of his employment. A jury awarded Roberts approximately $1.4 million in damages.
