MEMORANDUM OPINION

BULLOCK, District Judge.

Plaintiff brought this action in the General Court of Justice, Superior Court Division, Durham County, North Carolina, pursuant to Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. (“Title VII”). Defendant timely removed the action. Plaintiff asserts a claim based on gender discrimination, race discrimination, and retaliation. Before the court is Defendant’s motion to dismiss the complaint. Also before the court is Defendant’s motion for summary judgment.
