MEMORANDUM OPINION
JOE J. FISHER, District Judge.
E.D. Hayden sued his former employer, Texas-U.S. Chemical Company, on his claim for benefits under the company’s Permanent and Total Disability Plan (“the Plan”). Following a trial before the court on December 15, 1980, judgment was entered for Hayden May 27, 1981 in the amount of $30,463.20.
Texas-U.S. appealed the decision to the Court of Appeals for the Fifth Circuit on June 22, 1981, and the Court of Appeals rendered a decision on August 6,1982. The court vacated the judgment below and remanded the case for further consideration by the…
