I. Introduction 1
Before the Court is a joint motion by Defendants to compel discovery of documents which the United States is asserting do not have to be disclosed based on various evidentiary privileges. Defendants object to the Government’s use of the deliberative process privilege to withhold documents from criminal discovery. They also claim that documents are being improperly withheld by the Government on the basis of 5 U.S.C. § 552a, 18 U.S.C. § 1905, and 16 U.S.C. § 470hh.
