The complaint for patent infringement was filed in this Court on March 21, 1955. B & M Corporation, a Louisiana corporation with its principal place of business at Houma, Louisiana, is the plaintiff, and Ewell Clark Miller, an individual doing business under the firm name of Kool-Vent Metal Awning Company of Kentucky, is the nominal defendant. The complaint alleges that U. S. Letters Patent No. 2,542,919 were issued to Dewey J. Freeman February 20, 1951 (the application for allowance of the patent was filed June 13,1946).
