The defendant, Frank Turnbow, and Kathryn Moss were jointly indicted by the grand jury of the State of Oregon in and for Union County, charged with the crime of, assault with intent to rob one John L. Neeley. Thereafter Turnbow and Moss were placed on trial, but soon after the commencement thereof Kathryn Moss, codefendant of Frank Turnbow, was dismissed upon the motion of the prosecution, to become a witness on behalf of the state. The only serious question presented by the record is the matter of the sufficiency of the evidence to meet the provision of the Code (Section 1540, Oregon Laws), providing that:
“A conviction cannot be had upon the testimony of ah accomplice, unless he be corroborated by such other evidence as tends to connect the defendant with the commission of the crime, and the corroboration is not sufficient if it merely show the commission of the crime, or the circumstances of the commission.”
