THORNBERRY, Circuit Judge:
The original complaint in this case was filed on May 21,1973, by Frank L. Eastland under § 717 of the Civil Rights Act of 1964, as amended by § 11 of the Equal Employment Opportunity Act of 1972, 42 U.S.C. § 2000e-16, the Civil Rights Act of 1866, 42 U.S.C. § 1981, and the Fifth Amendment of the United States Constitution. In addition to allegations of discrimination against him in his individual capacity, Eastland’s complaint requested relief on behalf of “. all past, present, and future black employees and applicants for employment in TVA’s Muscle Shoals, Alabama…
