Edward Locke was indicted for the intentional murder of Pearly Jackson during the course of an arson in violation of § 13A-5-40(a)(9), Code of Alabama 1975. The jury found the appellant "guilty as charged in the indictment." The State and the appellant agreed to waive the jury's participation in the sentencing process and allowed the trial judge to impose sentence. The trial judge sentenced the appellant to life imprisonment without parole.
