This is a summary proceeding under article 83 of the Civil Practice' Act to remove the tenant on the ground he holds over and continues in possession without permission of the landlord. Tenant occupies the premises under a written lease with landlord’s predecessor in title from May 1, 1945, to April 30, 1946. On May 1, 1946, tenant sent Joyce, the former owner, a check for $36 for the rent. Mrs. Joyce subsequently cashed this check. Landlord bought the premises on May 20, 1946, and immediately applied for an Office of Price Administration certificate authorizing removal of respondent. The…
