This matter comes before the Court on the Motion for Summary Judgment filed in this proceeding on August 16,1994, by the defendant Southern Wipers, Inc. (hereinafter “Southern Wipers”). By its Motion, Southern Wipers seeks judgment in its favor in an adversary proceeding commenced by the former trustee Robert E. Brizendine, and currently pursued by the successor trustee Frank W.
