OPINION

RILEY, Judge.

Respondents-Appellants James Carter Bauermeister and the Indiana Civil Rights Commission (the Commission) seek appellate review of the Gibson County Cireuit Court's judgment in favor of Petitioner-Appellee Southern Indiana Gas & Electric Company (SIGECO) in Bauermeister's action concerning discrimination based on a disability.1

We reverse.
