TAMILIA, Judge:

This is an appeal from an order dismissing appellant’s exceptions to a decree of equitable distribution subsequent to divorce.1 A brief chronology of crucial events is in order.

On January 1, 1980, appellant/husband filed a complaint in divorce in Allegheny County alleging indignities. Appel-lee’s answer of February 1st sought dismissal. In October appellant commenced an action for partition of entireties property by filing his complaint in Westmoreland County.
