Michael J. L. appeals from the nonfinal order of the juvenile court denying his motion to dismiss a delinquency petition filed contemporaneously with a waiver petition. Michael J. L. contends that the time requirements of sec. 48.25(2)(a), Stats., were not met and that the mandatory language of that statute requires dismissal of the delinquency petition with prejudice. The juvenile court found that the state had violated the statutory time requirements. The court reasoned that the waiver petition deprived it of jurisdiction to hear and decide the motion to dismiss the delinquency petition.…
