This action was commenced before the police magistrate of the city of Dickinson. The defendant was charged with keeping and harboring one female dog within the city without having the same registered and licensed as prescribed by the ordinance of the city. The police magistrate rendered judgment against the defendant and he appealed to the district court. The district court reversed the judgment of the police magistrate and ordered that the action be dis missed. Judgment was rendered accordingly, and the city has appealed.
