This contested matter is before the court pursuant to a dispute between a surety, National American Insurance Company (“National”), and the Unsecured Creditors’ Committee (“UCC”) oyer the disposition of money held by Messer Construction Company (“Messer”), construction manager for a public construction project at the University of Cincinnati which is owned by the state of Ohio for work at the University of Cincinnati.
